Activities in respect of which reports may be submitted under the Act on the Protection of Persons Reporting or Publicly Disclosing Information on Breaches (PPRPDIB)

Reports under the PPRPDIB may be submitted concerning violations of Bulgarian legislation or of the acts of the European Union referred to in the law, in the areas under Article 3 of the Act, related to the activity of “Capital Investments Fund”.

Submission of a report through the internal reporting channel of “Capital Investments Fund” (procedure for reporting breaches)

Please note that:

• No proceedings shall be initiated on anonymous reports or reports concerning breaches committed more than two years earlier.
• Reports that do not fall within the scope of the PPRPDIB and whose content does not provide grounds to be considered plausible shall not be examined.
• Reports containing manifestly false or misleading statements of facts shall be returned with instructions to the reporting person to correct the statements and information on the liability incurred for false accusation under Article 286 of the Penal Code.
• Where the report does not meet the requirements of the law for its submission, the reporting person shall be notified in order to remedy the irregularities. If the irregularities are not remedied within 7 days of the notification, the report together with the attachments thereto shall be returned to the reporting person.

For registering a report, a Standard Form approved by the national external reporting authority – the Commission for Personal Data Protection (CPDP) – shall be used, which must contain at least the following data:

1. full name, address and telephone of the reporting person, as well as email address, if available;
2. the name(s) of the person against whom the report is submitted and their workplace, if the report is submitted against specific persons and they are known;
3. specific data on the breach or on a real risk of such being committed, the place and period of the breach, if it has been committed, description of the act or circumstances and other facts, to the extent known to the reporting person;
4. date of submission of the report;
5. signature, electronic signature, or other identification of the reporting person.

Any type of sources of information supporting the allegations in the report and/or references to documents may be attached to the report, including data of persons who could confirm the reported facts or provide additional information.

A report may be submitted:

1. by mail to the address: 1 “Dyakon Ignatiy” Str., Sofia, with the envelope marked “Report under PPRPDIB” and the name of “Capital Investments Fund” – the report must be signed by hand;

2. through the electronic form at: signals_cif@bdbank.bg – the report must be signed with a qualified electronic signature (QES);

3. in person at the registry office at the address: 1 “Dyakon Ignatiy” Str., Sofia 1000, with the envelope marked “Report under PPRPDIB” and the name “Capital Investments Fund”.

Within 7 days after receipt of the report, the officer responsible for its examination shall acknowledge receipt and provide you with information on the registration of the report and its Unique Identification Number (UIN) and the date of receipt of the report. This unique identification number shall be attached to any subsequent information or communication in relation to the report.
